Terms & Conditions

Welcome to Giftus. By accessing or using Giftus ("the Platform," "we," "our," or "us"), you agree to be bound by these Terms and Conditions.

1. About Giftus

Giftus is operated as an independent side project by Askin John Samuel Rana Herbert Singh, based in Tamil Nadu, India. The Platform enables individuals ("Creators") to create event-based gift registries, share them with friends and family ("Contributors"), and receive contributions via integrated payment services.

Giftus acts solely as a technology platform facilitating transactions between Creators and Contributors. We are not a financial institution, bank, or payment processor.

2. Eligibility

You must be at least 18 years of age to use Giftus. By using the Platform, you represent and warrant that you are 18 years of age or older. This requirement exists because Giftus facilitates financial transactions, and Indian financial regulations, including RBI guidelines and Cashfree's Terms of Service, require users to be adults.

By completing identity verification, you further confirm that the information you provide is accurate, current, and belongs to you.

3. Account Registration & Verification

Creators must register an account and complete identity verification before their registry can be shared. Verification includes:

  • PAN Verification — to confirm your identity against government records.
  • Bank Account or UPI Verification — required before any settlement is processed to you.

Verification is powered by Cashfree SecureID. By submitting your PAN and bank details, you consent to these being verified against government and banking databases.

Giftus reserves the right to suspend or terminate accounts where verification fails or where we suspect fraudulent activity.

4. Platform Fee

Transaction Fee: Giftus charges a 2.5% transaction fee on every contribution received. This fee is inclusive of all payment processing charges. No additional charges apply to Contributors.

The fee is automatically deducted at the time of settlement. For example, if a Contributor pays ₹1,000, the Creator will receive ₹975 (₹25 deducted as the transaction fee).

5. Creator Responsibilities

  • Provide accurate information about your event and registry.
  • Use collected funds for the stated event purpose.
  • Not use Giftus for fraudulent, illegal, or misleading purposes.
  • Communicate clearly with your Contributors regarding event cancellations.
  • Comply with all applicable Indian laws and regulations.

Giftus is not responsible for how Creators use the funds received.

6. Contributor Responsibilities

  • Contributions are voluntary gifts and are not guaranteed to be refunded unless eligible under our Refund Policy.
  • You are contributing to a registry created and managed by a third party (the Creator).
  • Giftus does not verify the legitimacy of any specific event beyond identity verification of the Creator.

7. Registry Lifecycle

  • Draft — created but not shareable; Creator's identity not yet verified.
  • Active — Creator is verified; registry link is shareable and accepting contributions.
  • Closed — event date has passed or Creator has manually closed the registry.
  • Cancelled — Creator has cancelled the event.

8. Settlement

Creators may request settlement of collected funds at any time before or after the event date. Settlement requires a verified bank account or UPI ID. Settlements are processed via Cashfree Payouts, typically 1–3 business days.

9. Limitation of Liability

Giftus is provided "as is" and "as available." To the fullest extent permitted by applicable law, Askin John Samuel Rana Herbert Singh shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform, actions of Creators or Contributors, or temporary unavailability due to maintenance.

10. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Tamil Nadu, India.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance. Material changes will be communicated via email.

Privacy Policy

Giftus is committed to protecting your personal information. This Privacy Policy explains what data we collect, how we use it, and your rights. We comply with the Digital Personal Data Protection Act, 2023 (DPDPA).

1. Information We Collect

From Creators:

  • Name — for registration and identity verification.
  • Email address — for account communication and notifications.
  • PAN number — for identity verification via Cashfree SecureID. We store only the verification result and last 4 characters, not the full PAN.
  • Bank account / UPI ID — collected at settlement time for payout processing.

From Contributors:

  • Name and message — if provided during contribution (optional).
  • Payment information — processed entirely by Cashfree Payments. Giftus does not store card numbers, CVVs, or bank credentials.

Automatically Collected:

  • Usage data — pages visited, features used, device type, collected via Firebase Analytics.
  • Log data — IP addresses and browser information for security.

2. How We Use Your Information

  • Account creation and authentication
  • Identity verification (KYC) via Cashfree SecureID
  • Processing settlements to verified bank accounts/UPI
  • Sending transactional emails
  • Fraud prevention
  • Platform analytics and improvement (anonymised)
  • Legal compliance

3. Identity Verification (Cashfree SecureID)

When you submit your PAN for verification, your details are transmitted securely to Cashfree's servers and checked against government databases (NSDL/UTIITSL). We store only the verification result — not a raw copy of your PAN. Cashfree's own privacy policy governs how they handle data submitted to their APIs.

4. Data Sharing

We do not sell your personal data. We share data only with:

  • Cashfree Payments — for identity verification and payment processing.
  • Google / Firebase — for analytics and cloud infrastructure.
  • Law enforcement — when legally required.

5. Data Retention

  • Account data is retained while your account is active.
  • Verification records are retained for a minimum of 5 years (Indian financial regulations).
  • Transaction records are retained for 7 years as required by law.
  • Upon account deletion, personal data is anonymised or deleted within 30 days, except where legally required.

6. Your Rights (DPDPA 2023)

You have the right to access, correct, or request erasure of your personal data (subject to legal retention requirements). You may also withdraw consent for non-essential data processing. To exercise these rights, email support@giftus.io.

7. Data Security

We implement industry-standard security: encrypted data transmission (HTTPS/TLS), Firebase Security Rules, server-side API calls to prevent credential exposure. Payment data is never stored on our servers.

8. Children's Privacy

Giftus is not intended for individuals under 18 years of age. We do not knowingly collect personal data from minors.

Refund & Cancellation Policy

This policy outlines conditions under which refunds may be issued. By contributing to any registry on Giftus, you acknowledge and accept this policy.

All payment processing is handled by Cashfree Payments. The 2.5% platform fee (inclusive of payment processing charges) is non-refundable once a transaction has been processed.

1. Standard Refund Requests

Contributors may request a refund if the request is submitted before the event end date. Email support@giftus.io with:

  • Subject: Refund Request — [Event Name]
  • Your full name and email used during contribution
  • Event name and Creator's name
  • Date and amount of contribution
  • Reason for the refund request
  • Proof of payment (screenshot or transaction ID)

Approved refunds are credited to the original payment source within 5–7 business days, net of the 2.5% transaction fee.

2. Refunds After Event Ends

Refund requests after the event end date are generally not eligible. Exceptions may be considered for demonstrable fraud or technical error.

3. Event Cancellation by Creator

When a Creator cancels an event:

  • All Contributors are notified via email.
  • Contributors have 5 calendar days to claim a refund.
  • Unclaimed amounts after the 5-day window are settled to the Creator.
  • The Creator may choose to proactively refund all Contributors.

4. Non-Refundable Situations

  • Request submitted after event end date (outside exceptional circumstances).
  • Contribution already settled to Creator who declines refund.
  • Contributor fails to claim within 5-day cancellation window.
  • Request missing required proof of payment.
  • The 2.5% platform fee on any processed transaction.

5. Processing Timelines

  • Review: 1–2 business days
  • Processing: 3–5 business days to appear in original payment source
